CUMBERLAND ASSIZES. 

  

WM. BROWNE, of Tallentire Hall, Esq. High Sheriff. 

 

ON Wednesday afternoon, the Sheriff dined at the Coffee House, with about one hundred friends, according to custom. After the cloth
was removed, the usual toasts were drank with great spirit. About half past six, he proceeded to Stanwix, escorted by Javelin Men,
and a number of Gentlemen on horseback and on foot, to meet the Judges. Their Lordships arrived about seven, and immediately went to
the Court Houses and opened the Commission. On the following morning, Thursday, the Court re-assembled, and after the usual
preliminary business, Mr. Justice WOOD, delivered his charge to the Grand Jury:- 

 

"Gentlemen of the Grand Jury-You are so well acquainted with the nature of the duty which you have to discharge, there is no
necessity for me to address you on that head.-In looking over the Calendar of the Prisoners, though not numerous, I perceive several
offences in it of a capital nature; but there is only one of them on which I shall remark. I observe a charge against an individual
of cutting and stabbing another person with a sword. By an act passed in the 43rd of his present Majesty, this, if done unlawfully,
wilfully, and maliciously, is a capital crime; but if it is done without malice, arising from provocation, or such like cause, it is
only a misdemeanor.-Now you will strictly attend to the evidence, which will be laid before you, from whence you will draw your
conclusions. If you are convinced that it was done with malice prepense you will place it under the former denomination. If the act
arose from provocation, it will be your duty to consider it in the latter point of view. There is nothing else calling for
particular observation. In the whole of your enquiries you will shape your decisions according to the evidence adduced on each
particular case; your line of duty is plain, and I am sure you will not deviate from it."
