N I S I P R I U S.
EARL OF EGREMONT v. SIR F. F. VANE, BART.
This was an interesting cause to the parties concerned, respecting the manorial right of Wythorp, a mesne manor of the honour of
Cockermouth. The Earl of Egremont's agents produced an immense mass of old records to prove that Wythorp was under his jurisdiction,
and that he was in the habit of getting waifs and strays from that manor.-The Defendant, on the other hand, produced a number of
deeds, proving that his fore-elders purchased Wythorp from Sir Richard LOWTHER in 1606, whose fore-fathers had it in marriage by
Alice LUCEY, coheir of Richard LUCEY of Allerdale. A great number of Witnesses were examined respecting the boundary, which had
never been properly ascertained before. Defendant also proved taking waifs and strays, keeping a bailiff and gamekeeper, and
quarrying stones to build with, at Armathwaite and other places, and discharging persons from hunting on Wythorp; but our limits
will not permit us to go into a detail of what occupied the Court from 9 o'clock in the morning till 11 o'clock at night, when the
Jury gave a verdict for the Defendant.
[The commons on Derwent hills were about to be divided, but till this cause was settled the commissioners could not proceed in the
survey.-There were 38 issues upon division of commons, but they were all given into the Jury without any defence.]
LAW v. HOGG.
This was action of trespass respecting a road through a field. A great number of witnesses were examined to prove it a public road,
and also as many to prove damages. The Plaintiff got a verdict with 1s. damages.
